New Charges for Kathleen Kane; Cop Killer Sentenced; Man Sexually Assaults 6-year-old

Pennsylvania Attorney General Kathleen Kane was ordered held for trial on more charges related to Kane's alleged leak of grand jury material and then lying about it to another grand jury last year. A Montgomery County judge upheld charges of felony perjury and misdemeanor false swearing and obstruction. Investigators discovered that Kane had signed an oath shortly after taken office binding her to secrecy in grand jury matters. Last year during testimony she told the grand jury that she never signed such an oath. Kane's lawyer, Gerald Shargel, argued that she simply did not recall signing the oath and wasn't lying about it, it was an honest mistake. The discovery of the oath also discredits her claim she was just a stay-at-home mom in 2009, thus absolving her of legal liability in disclosing information from that grand jury. By becoming Attorney General and signing that oath, she had the duty to keep all grand jury information secret, even prior to her term.

A Philadelphia man convicted of killing an off-duty cop on his way home from work was sentenced today. Chancier McFarland will spend 20 - 40 years in state prison for the murder of Officer Moses Walker Jr. McFarland pled guilty to third degree murder, robbery, and conspiracy as part of a plea deal to testify against his accomplice, Rafael Jones. It happened in the early morning hours of August 18th, 2012. Walker was in street clothes, heading to the bus stop in North Philadelphia after his shift, when Jones and McFarland attempted to rob him. Walker, a 19-year-veteran of the force, was shot multiple times. Jones was previously sentenced to life in prison.

A man is in custody after breaking into an apartment and sexually assaulting a 6-year-old girl. It happened around 4:00 a.m. Monday morning at the Hatfield Village Apartments in Hatfield Township. Police responded after the victim's 11-year-old brother called 911 and told them someone had broken into their home and done "something" to his sister. When police arrived, the suspect, Oscar Rivera Herrera, was lying on the floor of a bedroom. The girl's stepfather had discovered the suspect and held him until police arrived. Herrera had entered through a window and climbed into bed with the girl. He told police he broke into the apartment about 2 months ago but no one was home. Herrera is charged with Rape, Rape of a Child, Statutory Sexual Assault, Sexual Assault, Indecent Assault, Burglary, Criminal Trespass, and related offenses. His bail was set at $1 million. Police are asking anyone with information about Herrera to contact them at (215) 855-0900.
