PA Texting Law to Overshadow Philadelphia Cellphone Ban

The Pennsylvania state's new texting while driving ban, effective March 8, 2012, will effectively wipe out the 2 year old Philadelphia city ordinance banning total cell phone use. The state law only bans texting but allows for other use of the devices such as dialing, GPS, music, etc. You can hold and manipulate the device any way use wish, just not for texting. Philadelphia's law banned any use of a phone including phone calls but the state law will trump any local ordinances.

Critics of the state law have pointed out that it will be almost impossible to enforce, stating that officers will not be able to tell what a driver was doing with their phone before they decide to pull them over.

Councilman Bill Green, who wrote the Philadelphia bill, said. "The Philly ban was very clear if you are holding your cell phone in your hand, no matter what you are doing with it, that was a violation of the law.  It was simple and easy to enforce."

In Philadelphia, almost 30,000 citations have been issued for violations of the cell phone ordinance. Also, studies have shown that drivers seem to be taking notice, with less drivers in the city using their devices with driving, down to 1 in 10 from 1 in 7 before the city wide ban. City officials fear that drivers will start to revert to old habits and begain to drive city streets using devices again while behind the wheel once the state law takes effect.
